Terms of Service

Overview

CargoFlowPlus provides freight operations software, including FlowPulse Intelligence, to help teams monitor shipment signals and make timing decisions. By accessing or using the service, you agree to these terms.

Your Account

You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate account information and update it when needed.

Use of the Service

You may use CargoFlowPlus only for lawful business purposes. You may not misuse the service, interfere with its operation, reverse engineer it, or attempt to access data or systems that are not yours.

Operational Recommendations

CargoFlowPlus provides operational visibility, ETA interpretation, and operational recommendations based on available signals and evidence. The service is intended to support decision-making only. It does not replace your own operational judgement, carrier confirmations, terminal instructions, customs updates, or other official sources. Final operational decisions remain your responsibility.

Data and Integrations

The platform may process shipment references, booking numbers, container numbers, location signals, milestone data, and related operational inputs that you provide or connect. You confirm that you have the right to use and share this data with the service.

The service may rely on carrier, terminal, port, vessel, AIS, customs, and third-party data sources. Interruptions, delays, inaccuracies, API changes, or provider outages may affect the availability, accuracy, or timing of outputs.

Availability

We aim to keep CargoFlowPlus reliable and available, but we do not guarantee uninterrupted service. Maintenance, upgrades, third-party data interruptions, and external provider changes may affect availability or outputs.

Intellectual Property

CargoFlowPlus, FlowPulse Intelligence, and all related software, designs, content, and underlying systems remain the property of their owners. These terms do not transfer ownership of the platform or its technology.

Suspension or Termination

We may suspend or terminate access if these terms are breached, if the service is misused, or if continued access would create security, legal, or operational risk.

Disclaimer

CargoFlowPlus is provided on an "as available" basis. While we work to provide accurate and useful operational insight, we do not guarantee that all outputs, ETAs, signals, alerts, or recommendations will always be complete, current, accurate, timely, or error-free.

We do not guarantee shipment arrival times, pickup readiness, port availability, customs clearance, carrier performance, terminal operations, alert delivery, or the avoidance of demurrage, detention, storage, missed booking, trucking, or other operational costs.

Refunds and Service Credits

Subscription fees are non-refundable except where required by law or expressly stated in these Terms.

If you are charged in error or charged more than once for the same subscription period, we will refund the incorrect charge.

We do not provide refunds because of third-party data delays, data inaccuracies, ETA changes, alert delays, recommendation outcomes, shipment delays, carrier changes, port congestion, customs issues, or other freight operational events.

If the service is materially unavailable due to an issue within our reasonable control for a continuous period, we may, at our discretion, consider a pro-rata service credit or partial refund for the affected service period.

In exceptional cases, we may offer a service credit or partial refund as a goodwill gesture. Any such credit or refund does not constitute an admission of liability.

Refunds, service credits, or goodwill credits are limited to subscription fees paid for the affected service period. We do not reimburse or compensate for operational losses, including demurrage, detention, storage charges, trucking costs, missed pickup windows, missed bookings, lost profit, loss of business, customer claims, or other freight-related costs.

Limitation of Liability

To the maximum extent permitted by law, CargoFlowPlus will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or business-interruption losses.

We will not be liable for loss of profit, loss of revenue, loss of business, loss of goodwill, loss of anticipated savings, loss or corruption of data, customer claims, demurrage, detention, storage charges, trucking costs, missed bookings, missed pickup windows, shipment delays, carrier delays, terminal delays, customs delays, or other freight, logistics, or operational costs arising from use of the service.

Our total aggregate liability for any claim relating to the service will not exceed the fees paid by you to CargoFlowPlus for the affected service during the three months before the claim arose.

Nothing in these Terms excludes or limits liability where it cannot be excluded or limited by law.

Changes

We may update these terms from time to time. If we make material changes, we will update the effective date and post the revised version here.
